var(--awb-text-transform); background-color: var(--awb-bg-color);\">Camera surveillance on the street, in shops, businesses, homes and other locations is now a normal phenomenon.<br \/>\nMost of the time, the CCTV is announced, but sometimes it takes place in secret.<br \/>\nHowever, the law sets limits here.<br \/>\nFilming or photographing in a place accessible to the public is allowed, but the presence of cameras must be clearly communicated.<br \/>\nIn confined spaces \u2013 such as at work \u2013 people may not be filmed.<br \/>\nThis is only allowed if there is a good reason and no suitable alternative measure can be devised.<br \/>\nBut even then, it must be announced explicitly.      <\/strong><\/h2>\n<h3 class=\"fusion-responsive-typography-calculated\" style=\"--fontsize: 20; line-height: 1.45;\" data-fontsize=\"20\" data-lineheight=\"29px\">Mandatory warning in case of camera surveillance<\/h3>\n<p>  Filming in a public space without notice is prohibited and therefore punishable.<br \/>\nPublic space includes all spaces open to the public, including private property such as shops, catering establishments, company car parks, casinos and swimming pools.<br \/>\nVisitors or passers-by of these open spaces must be able to know that they can be filmed.<br \/>\nSigns are often placed at the entrance announcing the camera surveillance.<br \/>\nNowadays, many shops also install a confrontation monitor, directly after the entrance, on which the camera images are visible.<br \/>\nOthers mount a camera that is clearly visible to every passer-by.<br \/>\nThat, too, is enough to serve as an announcement.<br \/>\nAnother way to communicate the camera surveillance is to communicate this on an invitation or ticket.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-1 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-bg-size:cover;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-column-wrapper-legacy\"><div class=\"fusion-text fusion-text-2\"><h3>Data processing in camera surveillance<\/h3>\n<p>  When camera surveillance is used, personal data is regularly processed.<br \/>\nProcessing of personal data falls under the <a href=\"https:\/\/mactwin.com\/en\/gdpr-quick-scan-dpia-for-security-systems\/\" target=\"_blank\" rel=\"noopener noreferrer\">General Data Protection Regulation (GDPR).<\/a><br \/>\nThe supervisory authority in the Netherlands is the Dutch Data Protection Authority.<br \/>\nOrganisations no longer have to report the processing of personal data to the Dutch Data Protection Authority, but have a documentation obligation.<br \/>\nThis means that, at the request of the Dutch Data Protection Authority, organisations must be able to demonstrate with documents (a register of processing operations) that they comply with the privacy regulations.<br \/>\nIn addition, the Authority asks for the risks of said data processing to be identified and for appropriate measures to be taken.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-2 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-padding-top:25px;--awb-padding-right:25px;--awb-padding-bottom:25px;--awb-padding-left:25px;--awb-overflow:hidden;--awb-bg-size:cover;--awb-border-color:#ee7824;--awb-border-top:1px;--awb-border-right:1px;--awb-border-bottom:1px;--awb-border-left:1px;--awb-border-style:solid;--awb-border-radius:5px 5px 5px 5px;--awb-margin-top:50px;--awb-margin-bottom:45px;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-column-wrapper-legacy\"><div class=\"fusion-text fusion-text-3\"><p><strong>Mandatory keeping of records (even if you already have an existing camera system!)<\/strong> As the owner of a camera system, you are obliged to keep a register of all activities in which personal data is processed since the introduction of the GDPR.<br \/>\nIn any case, the following must be included in this register:   <\/p>\n<ul>\n<li>Contact details of the processing party<\/li>\n<li>Purpose(s) of the processing of the personal data<\/li>\n<li>A description of the category of persons whose personal data is processed (data subjects)<\/li>\n<li>Recipients of personal data (third parties)<\/li>\n<li>The period for which the data will be stored and deleted<\/li>\n<li>A (general) description of security measures taken<\/li>\n<\/ul>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-3 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-bg-size:cover;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-column-wrapper-legacy\"><div class=\"fusion-text fusion-text-4\"><h3>Camera surveillance in confined spaces<\/h3>\n<p>  Stricter rules apply to photography or filming in areas that are not &#8216;accessible to the public&#8217;, such as a house, garden or office.<br \/>\nHere, people expect to have privacy.<br \/>\nFilming or photography is prohibited unless this has been announced and no suitable alternative can be devised.<br \/>\nIt doesn&#8217;t matter if the camera is hung up somewhere or held by someone.<br \/>\nThe possession of a photograph or film that has been made in this prohibited way is therefore also prohibited.<br \/>\nA workplace is such a closed environment where filming or photography is not allowed.<br \/>\nThe employer must inform employees about camera surveillance, for example via the company regulations or posted signs.        <\/p>\n<h3>Hidden cameras<\/h3>\n<p>  Only in very exceptional cases may hidden cameras be used.<br \/>\nMost of the time, these aim to catch employees in irregularities.<br \/>\nThree important criteria apply:    <\/p>\n<ol>\n<li>The employer may only specifically film those employees who may be involved.<br \/>\nSo don&#8217;t preventively everyone. <\/li>\n<li>The employer must have notified in advance that hidden cameras may be used.<br \/>\nHe doesn&#8217;t have to say when they will be installed or where they will be hung. <\/li>\n<li>The use of hidden cameras must be proportionate.<br \/>\nThere should be no other options (such as detection gates at the staff exit) to deal with the irregularities. <\/li>\n<\/ol>\n<p>  The law is strict here, because surveillance with a hidden camera is a serious invasion of privacy.<br \/>\nYou must therefore be able to show that you really have no choice but to introduce this far-reaching measure.<br \/>\nBut even with &#8216;normal&#8217; camera surveillance, the following applies: stick to the rules and make sure that you do not commit a crime yourself.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-4 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-padding-top:25px;--awb-padding-right:25px;--awb-padding-bottom:25px;--awb-padding-left:25px;--awb-overflow:hidden;--awb-bg-size:cover;--awb-border-color:#ee7824;--awb-border-top:1px;--awb-border-right:1px;--awb-border-bottom:1px;--awb-border-left:1px;--awb-border-style:solid;--awb-border-radius:5px fusion-text-5\"><p><strong>Use as evidence<\/strong> What if illegally obtained images show a crime (e.g. a burglary or theft)?<br \/>\nMany people think that these images are then unusable.<br \/>\nThis is incorrect.<br \/>\nThe Dutch police may simply use such images in the investigation of criminal offences, and an employer can also use such images in, for example, a dismissal procedure.<br \/>\nHowever, the creator of the images does run the risk of a fine or even imprisonment.<br \/>\nThe police themselves, as a government agency, are not allowed to use images that have been unlawfully obtained by self-installed cameras.<br \/>\nThis also applies to recordings from cameras that have been installed by citizens or a company at the request of the police.<br \/>\nStricter rules apply to government organisations in this respect.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-5 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"--awb-bg-size:cover;\"><div class=\"fusion-column-wrapper
